To the School Board Directors of Cumberland Valley School District:
I am writing to ask why Cumberland Valley School District continues to oppose the release of a police report and security footage concerning an incident involving “The Big Red Truck.”
Unless the Cumberland Valley Police Department has decided to reopen the matter and pursue criminal charges against the driver, I do not understand why these records cannot be released. I was previously told by the responding officer that the video and police report would be available. Yet the District’s Right-to-Know office and its solicitor, Johnson & Duffie, appear to be contesting the release of these records.
That raises serious questions. Is there something incriminating in the video? Is the District withholding the footage because the person driving the truck is a school board member? I am asking these questions because I was directly involved in the incident, and I have a legitimate interest in knowing how many inches that vehicle came to making contact with me in an otherwise empty parking lot. I know what I witnessed that day, but I would like to see the actual video for myself.
By continuing to fight the release of this information, the District creates the appearance that there is something it does not want the public to see. If there is a legitimate legal reason the records cannot be released, I believe taxpayers deserve a clear explanation of that reason.
I also question the amount of taxpayer money being spent on legal representation in Right-to-Know matters. Some members of this board recently went to the state Capitol seeking additional state funding, and state legislators responded by providing additional resources. Are those legislators aware of how much Cumberland Valley School District is spending on legal services to oppose citizens seeking access to public records?
These are taxpayer-funded resources. Citizens should be able to ask reasonable questions and obtain public records without feeling that the District will use its legal resources to make access unnecessarily difficult.
I am also concerned about the message this situation sends to members of the community. If citizens cannot obtain a police report and security footage concerning an incident occurring on school property, they may reasonably question whether reporting an incident through the District is the best option. Transparency and public confidence depend on citizens believing that records will be handled openly and appropriately.
I am therefore asking the School Board to reconsider its position and release the police report and security footage, provided there is no legitimate legal basis preventing their disclosure. Because the board has not responded to my emails on this subject, I am forced to do an open letter for the public to see.
If the District believes these records are exempt from disclosure, please explain specifically what legal exemption applies and why. I would also ask the Board to explain to taxpayers how much the District has wasted on legal fees associated with opposing the release of these records and other Right-to-Know requests.
The public deserves transparency. If there is nothing improper about the incident or the records, releasing them should help resolve questions rather than create additional suspicion.
Will this Board reverse course and demonstrate a genuine commitment to transparency, or will it continue wasting taxpayer-funded resources fighting citizens who are seeking access to public records?
I respectfully ask you to release the video and police report, or provide the public with a specific and transparent explanation of why you will not.

IF there was no threat and IF there was not any ill intention, why would Mr. Froelich have told me he preserved the footage, shared it with a CVPD officer and file a complaint to investigate? The officer even provided me with the incident number to be able to request under a RTK to request all the documentation including the video file. That RTK was also denied! I have copied and pasted the email exchange below. What are they trying to hide? If it was an innocent driving incident, there is nothing to hide.

I did preserve the footage involving the two trucks mentioned in your email and also shared this with CVPD Officer McMillen who was on duty at the District Office during this time period. When I caught a private investigator following my family and kids around taking pictures, I tracked down who he was and contacted the police. The police and the DA’s office investigated and called the private investigator. He confirmed that he was hired by Mike Cassidy on behalf of CVSD. When I asked The safety and security officer why CVSD was doing this he stated he had no knowledge of it and would never hire a private investigator to follow a family. So is Cassidy going rogue or is CVSD spending taxpayer money to stalk and harass children in the district.

The police were going to press charges for prowling since he was walking around my house and at nighttime/ pre dawn in the dark taking pictures. I have video of him doing so. As well as video of him taking pictures of my children who were in elementary school at the time. I should have pursued but the entire thing was just unnerving.

Did anyone else catch Cassidy lying to the public again last meeting saying there 25K emails requested when Cassidy knows for a fact there were over 18K+….he’s becoming more of a drama queen than Nestor. What shoddy legal advice.

Residents haven’t forgotten how Cassidy lied to the public telling them that (then) board member Bob Walker didn’t have a conflict of interest re: McCormick Farm when Walker was the attorney for the development that needed a road across McCormick Farm and Walker was the one who brought it to the board. So superficial and unethical.

Don’t forget about angry Mike Gossert who was board Pres during McCormick Farm scandal….yelling at an elderly women who exposed the Bob Walker connection at a public meeting. Gossert screamed and waved his finger. I was in the audience with her thinking “this guy was just caught”…

Isn’t Mike O’Brien only on board since it’s the only elected job he could find to build his resume for another failed attempt for higher office? If so, it’s not working out. His recent divorce exposed the faux campaign he ran for CV board. Now he head the Athletic committee and turns a blind eye to our kids getting bullied and safety ignored. What kind of man does that?
All I’ve seen him do is crawl on his knees around to capital begging for money and when he gets it, he complains that it wasn’t enough. What a weak and shallow person. At least his sudden-tan looks good for photo ops.

You aren’t giving him credit! He got the public comment sessions changed from 2- 3 minute sessions to 1 -5 minute session. I bet he is regretting that having to listen to 5 solid minutes of public comments. But then again, several members don’t listen. They chat and text and do anything but listen.

Where is doctor Verber? The cult followers of cv cures need to be told what to believe. They are all sitting around confused waiting for him to post the talking points and spin the truth. This is turning into another big newsworthy scandal like the infamous “Jess Rawls’ Wife Bus Video” (former CVSD H.S. Principal) that hit the T.V. networks after Rawls suppressed the damaging video of his wife for two years…costing another school district over $250,000. Wow…but this one directly involves the CVSD Board President and County Elected official Michelle Nestor herself…and her Big Red Truck!

I am a friend of Ms. Forsburg and support her 100%. I’ve always trusted her to do the right thing. I would like her to comment on this issue. I know she cares about what is right or wrong. This issue with Mrs. Nestor’s video seems to be political.

Forsburg has shown her true colors…it’s all political. What if it were a student almost hit instead of a Nestor critic? Would Forsburg be singing a different tune. Confirms that Forsburg has been bought and sold by the political action slush fund CV Cures that funded and backed her campaign. Disgraceful!!!!

If she “cares” why wouldn’t she be demanding transparency to see what actually happened with the truck in the parking lot? If she cares about right and wrong why wouldn’t they show the video to expose the wrong and dispel the falsehood of the claims, if they are untrue? Instead it is ignore and hide until it goes away? I try to give all board members the benefit of the doubt, but when they turn a blind eye to something that impacts the district and costs tax payers money I know where they stand. There is no reason for the RTK requests to be denied unless they are terrified of what will be discovered in them. We will see how Ms. Forsburg votes on this issue.

***Memo to Kingsley Blasco – it won’t work. Have people seen the link to adding names to “The List” of RINOs that nutjob wants to protest against. I intentionally avoided any appearance of RINOism because I say what happened to Mrs. Nestor and Mr. Carerras when their names were at the top of the list.
