Carlisle, Pennsylvania — A lawsuit filed on May 15 by Kelly Irene Potteiger and Robert J Zambuto, both of Mechanicsburg, against Cumberland County Republican Committee (CCRC) Chairman Louis J. Capozzi, Jr. and the CCRC, will proceed on the underlying complaint.
Potteiger and Zambuto, Republican candidates for State Committee, had filed an emergency motion in the Cumberland County Court of Common Pleas against the defendants seeking to stop the CCRC from distributing official poll cards to voters, which listed specific State Committee candidates chosen by the CCRC as “endorsed candidates” in violation of the CCRC bylaws. The emergency motion sought to stop the distribution of the poll cards before the primary election on May 19.
Due to an all-court recusal, the case was assigned to an out-of-county judge on May 20, which rendered the request for emergency relief moot. The remainder of the case will now proceed on the Plaintiffs’ Complaint, which was filed simultaneously with the emergency motion.
Defendants response is due at the end of June.
